Democrat documents contentions against tied vote in urgent race

NEWPORT NEWS, Va.— A court has so far not booked a hearing for a Virginia House hopeful who requesting that it announce her the champ of a race that may decide party control in the chamber.

Cheryl Penny is boss agent representative for Newport News Circuit Court. She said Wednesday that planning a hearing would require some investment if the three-judge board calls for one. Two judges live in different parts of the state.

Democrat Shelly Simonds has requested that the court reexamine a week ago’s choice to tie the race amongst her and Republican occupant David Yancey. The result would either enable Republicans to keep up control of the chamber or power a power-imparting consent to Democrats.

In the event that the court decreases to intercede, the state races board will decide the champ by drawing names from a bowl.
